By downloading, installing, or using the BetterUs mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the Service, including individuals who register accounts and individuals who pair with a subscribing partner ("paired users"). By using the Service in any capacity, you agree to these Terms.
If you are under 18 years of age, you may not use the Service. By using the Service, you represent and warrant that you are at least 18 years old.
BetterUs is a relationship wellness application designed for couples. The Service includes, but is not limited to:
The Service requires both partners to download the app and create individual accounts. Full functionality is only available when two accounts are paired within the same couple.
To use the Service, you must create an account by providing your first name, email address, and a password, and completing the onboarding questionnaire. You agree to:
We reserve the right to suspend or terminate accounts that contain false information or that we reasonably suspect have been compromised.
The Service is designed for use by consenting adult couples in a romantic relationship. By pairing with another user, you agree that:
Either party in a couple may disconnect the pairing at any time from within the app settings. Upon disconnection, shared data (journal entries, mood history) remains accessible to the user who created it but is no longer shared with the other party.
One subscription covers both partners. Only one person in the couple is required to hold an active paid subscription. The paired partner receives full access to the Service for the duration of the subscription.
BetterUs subscriptions are sold exclusively through our website via our payment processor, Stripe. Subscription fees are:
All fees are charged in US dollars. By subscribing, you authorise BetterUs to charge your payment method on a recurring basis (monthly or annually, as applicable) until you cancel.
Prices may change at any time. Where permitted by applicable law, we will give you at least 30 days' notice of any price change before it takes effect. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
All payments are processed by Stripe, Inc. By submitting payment information, you agree to Stripe's Terms of Service. BetterUs does not store your full card details.
New subscribers may be eligible for a 7-day free trial of the Service. During the free trial:
Free trials are available to new accounts only. We reserve the right to modify or discontinue free trial offers at any time without notice.
You may cancel your subscription at any time by managing your subscription through your account settings or by contacting us at help@getbetterus.com.
Upon cancellation:
Refund policy: Subscription fees are generally non-refundable. If you believe you were charged in error, contact us within 14 days at help@getbetterus.com and we will review your request on a case-by-case basis.
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your personal information.

BetterUs uses third-party AI providers (including Microsoft Azure OpenAI Service) to power the AI Relationship Coach, daily journal prompts, connection insights, and personalised spark suggestions. You acknowledge that:
BetterUs is not liable for any decisions made or actions taken based on AI-generated content within the Service.
You agree not to use the Service to:
We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated this conduct policy.
The BetterUs application, website, brand, design, and all content created by BetterUs (including AI-generated prompts, spark suggestions, and insights) are owned by BetterUs and are protected by applicable intellectual property laws.
You retain ownership of content you create within the Service, such as journal entries and coach conversation text. By submitting content, you grant BetterUs a limited, non-exclusive licence to store and transmit that content solely for the purpose of providing the Service to you.
You may not reproduce, distribute, or create derivative works from BetterUs content without our express written permission.
BetterUs allows couples to upload photographs and images ("Media") to a shared couple memory timeline stored in your private couple space. By uploading Media, you agree to the following:
Ownership. You retain full ownership of any Media you upload. BetterUs does not claim ownership of your photographs.
Licence Grant. By uploading Media, you grant BetterUs a limited, non-exclusive, royalty-free licence to store, transmit, and display the Media solely for the purpose of providing the Service to you and your paired partner. This licence terminates when you delete the Media or delete your account.
Your Representations. By uploading Media, you represent and warrant that:
Prohibited Content. You agree not to upload Media that:
Storage and Deletion. Uploaded Media is stored in Firebase Storage (a Google Cloud service). Media is associated with your couple. If you delete a photo, it is permanently removed from our storage. If you delete your account, all Media you uploaded will be permanently deleted within 30 days. Your partner retains access to Media they uploaded independently of your account status.
No AI training. We do not use uploaded photographs to train any AI model. Your images are used solely to display them to you and your partner within the app.
BetterUs reserves the right to remove any Media that violates these Terms without notice and to suspend accounts that repeatedly upload prohibited content.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
BetterUs is not a substitute for professional relationship therapy, couples counselling, or mental health treatment. If you or your partner are experiencing significant relationship difficulties, mental health challenges, or domestic abuse, please seek help from a qualified professional.
No relationship outcome warranty. BetterUs makes no representation, guarantee, or warranty — express or implied — that use of the Service will result in any particular relationship outcome, including but not limited to improved communication, increased intimacy, relationship repair, or prevention of separation or divorce. Relationship outcomes depend entirely on the choices, efforts, and circumstances of the individuals involved, which are wholly outside our control.
AI-generated content. Certain features of the Service use artificial intelligence to generate suggestions, conversation prompts, date ideas, and other content. This content is generated algorithmically and does not constitute professional advice of any kind — including relationship advice, psychological advice, medical advice, or legal advice. You should exercise your own independent judgement before acting on any AI-generated content. BetterUs is not responsible for any consequence arising from your reliance on AI-generated suggestions.
Third-party content and links. The Service may display date ideas, venue suggestions, or other content sourced from or linking to third parties. BetterUs does not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with third parties are solely between you and those parties.
To the maximum extent permitted by applicable law, BetterUs and its officers, directors, employees, agents, licensors, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any nature whatsoever, including but not limited to:
This exclusion applies whether or not BetterUs has been advised of the possibility of such damages and regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).
Liability cap. Our total aggregate liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to BetterUs in the 12 months immediately preceding the event giving rise to the claim, or (b) CAD $10.00.
Essential basis. The limitations of liability in this section reflect a reasonable allocation of risk between BetterUs and you, are a fundamental element of the basis of the bargain between us, and BetterUs would not provide the Service without these limitations.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.
You may stop using the Service and delete your account at any time by contacting us at help@getbetterus.com.
We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination:
We may update these Terms from time to time. When we make material changes, we will notify you by email (to the address associated with your account) and/or by displaying a prominent notice in the app at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service before the effective date.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which BetterUs operates, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration or the courts of the applicable jurisdiction, as determined by BetterUs. You waive any right to a jury trial or to participate in a class action lawsuit.
